Pixality Inc., a Delaware corporation doing business as Foreal ("Pixality", "Foreal", "we", "us", or "our"), is committed to protecting your privacy.

This Privacy Policy explains how we collect, use, disclose, and protect personal data when you use our websites, applications, and cloud-based services (collectively, the "Services"). Please read this policy carefully before using the Services.

By using the Services, you agree to the collection and use of information as described in this Privacy Policy.

Pixality acts as a data controller for account, usage, and service data, and as a data processor where we process User Content on behalf of customers.

2. Personal Data We Collect

2.1. Information You Provide

We may collect the following categories of personal information that you provide directly to us:

  • Identifiers: name, email address, username, company name, job title;
  • Account credentials and authentication information;
  • Billing and payment-related information (processed by third-party payment providers — we do not store full payment card details);
  • Communications with us, including support requests, emails, and feedback;
  • Location information: when you use the Foreal mobile application to capture spaces, we collect your precise geolocation data automatically with your prior consent. You may also enter location information manually in connection with a project or space;
  • User Content: photos, videos, 360° captures, 3D models, Gaussian splats, annotations, project communications, files shared via collaboration features, and associated metadata.

2.2. Information Collected Automatically

When you use the Services, we may automatically collect:

  • Device and network identifiers: IP address, device identifiers, browser type, operating system;
  • Usage data: log files, access times, features used, error logs, session duration;
  • Performance and diagnostic data.

When you use the Foreal mobile application to capture spaces, we automatically collect your precise geolocation data. Location access is requested once during active use of the application and is not collected in the background. You will be prompted to grant location permission by your device operating system before any location data is collected. On the web version of the Services, location is entered manually by you and is not collected automatically.

2.3. Information from Third Parties

We may receive information from:

  • Authentication providers (e.g. Google, Apple) when you use social login;
  • Payment processors, in connection with billing;
  • Analytics, hosting, and infrastructure providers;
  • Business partners, where permitted by law.

3. How We Use Personal Data

We use personal data to:

  • Provide, operate, and maintain the Services;
  • Process User Content and generate outputs (e.g. 3D reconstructions, Gaussian splats);
  • Improve, test, and develop our products and features;
  • Conduct internal research and development;
  • Train, evaluate, and improve artificial intelligence and machine-learning models that power the Services;
  • Monitor performance, detect fraud, and ensure platform security;
  • Communicate with users regarding support, updates, and service notices;
  • Comply with legal and regulatory obligations.

4. Use of User Content for AI and R&D

User Content may be used:

  • To provide and operate the Services;
  • To create derivative technical representations (e.g. point clouds, Gaussian splats, 3D reconstructions);
  • For internal research, testing, and product development;
  • For training, validating, and improving AI and machine-learning systems that power the Services.

AI models trained using User Content will not be sold or licensed to third parties, except in connection with a merger, acquisition, or sale of all or substantially all of Pixality's assets or business.

We do not sell User Content.

We do not publicly display identifiable User Content without your permission, unless it has been anonymised or aggregated such that it cannot reasonably be linked to you.

5. Purposes and Bases for Processing

We process personal data for the following purposes:

  • To perform our contract with you — to provide the Services you have requested;
  • To pursue our legitimate business interests — to improve the Services, conduct R&D, ensure security, and prevent misuse, where those interests are not overridden by your rights;
  • To comply with applicable law — where we are required to process data by law or regulation;
  • With your consent — where we rely on your consent, for example for certain communications, you may withdraw it at any time without affecting the lawfulness of prior processing.

6. Data Sharing

We may share personal data with:

  • Service providers and processors: cloud hosting, analytics, payments, support tools — all subject to contractual confidentiality and data protection obligations;
  • Professional advisers: legal, accounting, and compliance providers, under confidentiality obligations;
  • Law enforcement or regulators: where required by applicable law or valid legal process;
  • A buyer or successor: in the event of a merger, acquisition, or sale of assets, personal data may be transferred as part of that transaction. We will notify you via email or prominent notice on our website before your data is transferred and becomes subject to a different privacy policy.

We do not sell personal data to third parties.

7. Data Storage and International Transfers

The Services are operated by Pixality Inc., a U.S. company. Personal data you submit may be stored and processed using the following infrastructure providers:

  • Hetzner (Germany) — primary server infrastructure;
  • Google Cloud Services (United States and Europe) — backup storage and related infrastructure.

By using the Services, you acknowledge that your data may be stored and processed outside your country of residence. Where personal data is transferred internationally, we implement appropriate safeguards to ensure your data is protected in accordance with applicable law.

8. Data Retention

We retain personal data and User Content only for as long as necessary to:

  • Provide and improve the Services;
  • Meet legal, regulatory, or contractual requirements;
  • Resolve disputes and enforce agreements.

When data is no longer needed, we delete or anonymise it in accordance with our internal retention schedules. You may request deletion of your data at any time — see Section 10 below.

9. Data Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration, or misuse, including encryption in transit and at rest, access controls, and regular security assessments.

However, no system is completely secure. We cannot guarantee absolute security and encourage you to use strong passwords and keep your account credentials confidential.

10. Your Privacy Rights

10.1. Rights for All Users

Regardless of your location, you may:

  • Access the personal data we hold about you;
  • Request correction of inaccurate or incomplete data;
  • Request deletion of your personal data, subject to legal retention obligations;
  • Withdraw consent where processing is based on consent;
  • Lodge a complaint with your applicable data protection authority.

10.2. Additional Rights for California Residents (CCPA/CPRA)

If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: you may request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties with whom we share it;
  • Right to Delete: you may request deletion of personal information we have collected, subject to certain exceptions;
  • Right to Correct: you may request correction of inaccurate personal information;
  • Right to Opt Out of Sale or Sharing: we do not sell or share personal information for cross-context behavioral advertising;
  • Right to Limit Use of Sensitive Personal Information: we do not use sensitive personal information for purposes beyond those permitted under the CPRA;
  • Right to Non-Discrimination: we will not discriminate against you for exercising your CCPA/CPRA rights.

To submit a California privacy request, contact us at support@foreal.ai with the subject line "California Privacy Request." We will verify your identity before processing your request and respond within 45 days, with one 45-day extension where reasonably necessary.

11. Children's Data

The Services are not directed to children under the age of 16. We do not knowingly collect personal data from users under 16. If we become aware that we have collected personal data from a user under 16, we will suspend their account and delete their personal data promptly. If you believe we may have collected data from a user under 16, please contact us at support@foreal.ai.

12. Guest Access

Certain features of the Services allow registered users to invite guests to view project content without creating an account. Guests who access the Services through an invitation link do not provide personal data beyond what is inherent in the connection (such as IP address and device identifiers). The user who issues the invitation is responsible for ensuring that sharing project content with guests complies with applicable law.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. When we make material changes, we will notify you by email or by posting a prominent notice on our website prior to the changes taking effect.

Continued use of the Services after the updated Policy takes effect constitutes your acceptance of the changes.
